  Terms and conditions


Price


Our product prices are indicated per unit in euros on its websites www.mappeverbe.fr or www.mappeverbe.com, VAT (value-added taxes) inclusive at the applicable rate in France but excluding postage and packing. They are valid during the period of validity indicated on the order form.


For orders carried out within the European Union, our product prices are given VAT inclusive at the applicable rate on the order form and the invoice: 5,5% for books, 20% for postage and packing. For orders from French overseas department (DOM): the corresponding rates are 2,1% or 8,5%.


For orders carried out outside the European Union (including TOM : French overseas territories), you shall be deemed the importer for all purposes, and shall be responsible for all customs duties and clearance charges. You shall also be responsible for all other duties, levies, or government fees or taxes now in force or enacted in the future including, for example, any VAT.


All orders require full prepayment without charges (eg. banking fees) for us. Postage and packing fees always apply and are indicated on the order form. Extra fees may also be required for secured delivery (for example registered mail) when ordering from countries with poor postal standard delivery records. Please always check with us if you think you apply.

Payment


All orders must be prepaid by cheque (drawn against a bank in France) made payable to Mappeverbe Sarl, or by bank transfer to our Crédit Agricole bank account:

IBAN : FR76 1250 6200 0355 0163 7172 144 AGRIFRPP825.

You shall also be responsible for all banking fees that may incur.

Product information


We presents the products with all the necessary features on our websites or associated ones as required by the article L 111-1 of the French Consumer Act, which allows the customer to know the main features of the product he/she wishes to buy prior ordering. For technical reasons, actual products may differ from the images and the colours which appear on our websites.

Availability of the products


Our products are subject to availability. In the event of shortage, we will inform you as soon as possible. If the product is still unavailable after 30 days from the date we receive your order, we will again inform you of this exceptional delivery delay. You will then have the choice between a refund of the sums you have paid within 30 days following their payment, or the exchange of the product.

Delivery


Products are shipped according to the mode of delivery you have chosen (currently the postal services). Postage and packing fees always apply and are indicated on the order form. However, when ordering from a country with poor postal standard delivery records, we will only send your products through secured delivery (registered mail for example) with extra fees. Always check with us, if your country apply.

Guarantee of the products


The products we sell are new and guaranteed against any defect. In any case, you are entitled to the legal guarantee applicable against defects. You may return the products your order for any reason within 30 days of invoice date.

To ensure proper credit, returns must be preauthorized and shipped by traceable means, with return shipment prepaid. Products lost or damaged during return shipment will be charged to you.

Products must be returned in clean, undamaged, unmarked, resalable condition, and with the original invoice. Shipping and handling costs will not be credited.

If your order arrives in a damaged condition, save all products, shipping boxes, and packing materials. Contact us immediately. Claims for incorrect or damaged shipments must be made within 7 days from invoice date.

Data protection


Any data required are necessary for carrying out your order and will be held and/or transferred to third parties (for delivery for example) in strict accordance with the applicable French data protection laws (Article 34 of the "Loi informatique et Libertés" 6th January 1978). You may instruct Mappeverbe not to use your data for its own direct marketing purposes by ticking the appropriate box on the order form. You also have the right to consult, modify, correct and cancel any data that is being held about you by writing to us at the address given on our website.

Intellectual property


All intellectual property rights in all material (including, but not limited to, text, video, graphics, images, trademarks and logos) presented on www.mappeverbe.com, www.mappeverbe.fr or associated websites are the property of Mappeverbe, its licensors or other third parties and are protected by copyright or other intellectual property rights throughout the world. You must not infringe the intellectual property rights of Mappeverbe, its licensors or other third parties. You must not copy, reproduce, distribute, make available or publicly communicate website content, without prior written authorisation from Mappeverbe. Such content may be used for information purposes only and not for commercial aims or for distribution, public communication, transformation.
Mappeverbe is a trademark or registered trademark of Andre Marie BAVEREL in France and/or in other countries. The purchase of any Mappeverbe product does not grant you any licence to these rights (patents, trademarks, copyrights or other intellectual proprietary rights).

Force Majeure


Mappeverbe shall not be liable for any delay or failure in performance caused by or resulting from circumstances beyond its reasonable control; examples include acts of God, strikes, terrorist acts, war, riot, labor difficulties, government intervention, natural disasters and generally all cases recognized as such by jurisprudence.

Applicable law, language, competent court


These terms and conditions shall be governed by and construed in accordance with the French law. The original French version of these Terms and Conditions may have been translated into other languages. In the event of inconsistency or discrepancy between the French version and any other language version of these Terms and Conditions, the French language version shall prevail. By signing the order form or ordering, you expressly consent to be bound by these terms and conditions.
Any legal proceedings arising out of or relating to these terms and conditions will be subject to the jurisdiction of the courts of the district of Doubs in France. However, In the event of litigation or claims, you shall first contact us to find a mutual agreement.
